Building on their recent academic publication, The Medium and The Message: Personal Privacy and the Forced Marriage of Police and Telecommunications Providers, the authors argue that the contemplated scheme allowing law enforcement agencies to obtain CNA data without a warrant — which can be used as the key to building profiles of core biographical information about identifiable individuals — infringes reasonable expectations of privacy and is likely unconstitutional.
